Report and Status of Water Service Acquisition by Carefree UCFD

Carefree Residents:
Pursuant to the terms of a long-standing (August, 2005) Intergovernmental Agreement (IGA) between Carefree Utilities Community Facilities District (UCFD) and Cave Creek, Carefree UCFD is in the process of acquiring water service for approximately 1,000 Carefree residents and businesses in the “Carefree Service Area” (CSA), as defined by the IGA. A map of the CSA follows.
In order to determine the condition and fair market value of the Cave Creek water distribution system in the CSA, Carefree UCFD authorized a thorough evaluation by a professional engineering firm, Coe and Van Loo (CVL). The objectives of this evaluation were to develop factual information to enable Carefree to address the following areas:
• Perform the necessary investigations to assess the fair market value of the existing water infrastructure.
• Complete an engineering analysis of alternatives to disconnect from the Town of Cave Creek water utility, and recommend the most appropriate.
• For the alternative recommended, prepare an engineering cost estimate of the disconnections from the Cave Creek water utility needed in order to provide service from the Carefree Water Company.
This Report is now complete and Carefree UCFD is providing a copy to the Town of Cave Creek. We believe that all Carefree residents are entitled to review this Report as well.

This engineering evaluation factually identified many of the aspects of the Cave Creek Water System which have caused concern. These facts further clarify why Carefree UCFD is determined to complete the acquisition of these water service accounts in the CSA. Upon acquisition, Carefree UCFD will address the deficiencies identified and provide quality water service to all Carefree residents and businesses.
Based upon the Report’s findings, Carefree UCFD submitted an offer of $2.1 million to Cave Creek to acquire the water distribution components used for servicing the CSA. This offer has now expired. Cave Creek declined to respond or even to discuss the offer. As a result of and pursuant to the terms of the IGA, the binding Arbitration process is scheduled to begin in the near term. However, Carefree residents should be aware that this timeline may be influenced by Cave Creek’s desire to delay and disseminate misinformation regarding this agreed upon acquisition.
