Mayor Les Peterson began the meeting by saying that former Mayor David Schwan, who passed away from ALS, would have been 73 years old that day.
During Current Events, the Mayor announced that a special Council meeting would be held at 5 PM on Tuesday, September 17th, to review contracts for the Enchanted Garden Pumpkin Festival.
He reported that there have been considerable discussions with and letters from residents relative to Bike Week. The Town takes this seriously due to concerns that residents could be injured or worse during this time. They have met with the County Supervisors, and with Maricopa County Sheriff Penzone and his lieutenants. About 2 weeks ago Gary Neiss, Councilwoman Cheryl Kroyer, and the Mayor met with the Mayors of Scottsdale and Paradise Valley to look at all alternatives. "Bike Week is not something we want to grow or continue as is."

During Call to the Public, 15 year Carefree resident Lou Matusiak spoke. He is the president of his HOA but was speaking for himself. His is 1 of the 526 homes in Carefree that is serviced by the Cave Creek Water Company.

He expressed concern about the pace at which the water issue is getting resolved. Mr. Matusiak felt that Carefree was taking a reactive rather than proactive position in dealing with Cave Creek and what they are doing. He referenced the survey sent out by Cave Creek asking very leading questions phrased to get the answers they wanted. He didn't think Carefree responded to it. Most of the homes in Carefree that are on Cave Creek Water are within HOAs. He suggested getting the HOAs to canvas their residents, and also getting a petition drive going.
It was his understanding that Cave Creek hired a high priced attorney who specializes in water issues to represent them at the recent hearing, and that Carefree did not match that expertise. He wanted Carefree to do something to get Cave Creek's attention. The Engineering Report that was sent out was very thorough and complete. It included many safety issues and violations. Mr. Matusiak suggested possibly initiating a class action lawsuit to fight back.

Later in the meeting, Mayor Peterson addressed the water issue, saying that the Council is pursuing it as rapidly as the legal system allows. A lot is going on behind the scenes. The "research" conducted by Cave Creek was laughable in it's lack of professionalism, and was soundly rejected by the people who participated in the survey. Cave Creek was self defacing for having even tried such amateur tactics.
Carefree is pursuing this in the courts. In addition to the Town attorney, Carefree has one of the leading water attorneys in the state working on this. They are always looking for ways to strengthen the team. They were in court a couple of weeks ago. The Town takes this very seriously, recognizes that it is a serious problem for the residents, "and we are not stopping". The Mayor invited Mr. Matusiak to come into Town Hall to discuss it further, and offered to come out to HOAs to update their residents if so desired. "We are very serious about this."
