Stacey Bridge-Denzak began her presentation by saying that the Planning & Zoning Commission's (P&Z) hearts goes out to Commissioner Ralph Ferro, and we wish him a speedy recovery. We look forward to his return to the Commission.
She explained that work on the text amendment began with a workshop in May because the Planning Department, which also issues building permits, were seeing a significant number of very large casitas being built, housing amenities for living. The State sanctions vacation rentals. Carefree requires that whole properties be rented to maintain the spirit of the single family zoning district and to minimize neighborhood nuisances. While there is no problem with family members using casitas, there is only one family allowed per lot.
The text amendments to Definitions are meant to clarify the Ordinance. The changes are underlined.
(14) Building, Accessory: A detached structure which is subordinate to and incidental to the main use of the principal structure on the same lot. Accessory structures must be located in the building envelope and shall comply with the applicable sections of the Ordinance.
(49) Guest House: Living quarters in an accessory building or attached to the principal residence, which may include cooking facilities, used to house guests or domestic attendants of the occupants of the principal building, and which shall never be rented or offered for rent separate from the principal residence.
The changes and additions to Article lX of the General Provisions, Section 9.02, Accessory Buildings and Uses are underlined:
(3) The cumulative square footage of the guest house shall not exceed one-third (1/3) of the total square footage of the livable area of the principal structure.
(6) Both the principal structure and the guest house shall be served by a single electric meter (if applicable).
(7) The principal building and accessory structures shall be served by a single common driveway unless approved by the Zoning Administrator.
(8) Design of accessory buildings shall be compatible with the design of the primary dwelling in materials, colors and architectural style.
A P&Z public hearing was held in June and comments from the public were invited. None were received.
Councilman Stephen Hatcher thanked Ms. Bridge-Denzak for recognizing this trend in the community and called the proposed amendments an excellent piece of work to manage this issue which could become a real problem in the future. Mayor Les Peterson echoed the compliment.
The Mayor suggested an addition to (49) of the word "lease", which he viewed as longer term, vs. rent, which he thought of as shorter term. Town Attorney Mike Wright agreed that it was a good clarification, and it was changed to lease and/or rent. Councilwoman Cheryl Kroyer said she looked up the terms during the discussion. Leases are generally for a year. Rentals are for 30 days or more.
The motion to approve modifying the definition of guest quarters, accessory structures, and requirements related to regulation of these passed unanimously.
